Terms of Service

Welcome to IndyCare, operated by IndyCare317 Technologies LLC (“IndyCare,” “we,” “our,” or “us”). By accessing or using the IndyCare mobile application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

1. Overview

IndyCare is a non-medical home care matching platform that connects individuals seeking personal care, companionship, or daily living assistance (“Clients”) with independent caregivers (“Caregivers”). IndyCare does not provide medical care, nursing services, or health-related treatments.

2. Eligibility

You must be at least 18 years old to use the App. By registering, you represent and warrant that you meet this requirement and that all information you provide is accurate and complete.

3. Account Registration

  • Users must create an account and verify their email address.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You agree to notify us immediately of any unauthorized use of your account.

4. User Roles

a. Clients

  • Clients use the App to search for, view, and book Caregivers.
  • Clients are responsible for reviewing Caregiver profiles and making their own hiring decisions.

b. Caregivers

  • Caregivers are independent contractors, not employees of IndyCare.
  • Caregivers are responsible for setting their own schedules, rates, and service offerings.
  • Caregivers must consent to and pass a background check before being listed on the platform.

5. Background Checks (Caregivers)

All Caregivers must undergo a background check conducted by Checkr, Inc. By registering as a Caregiver, you authorize IndyCare and Checkr to obtain consumer reports and/or investigative consumer reports in accordance with the Fair Credit Reporting Act (FCRA).

6. Payments

  • All payments between Clients and Caregivers are processed through Stripe.
  • IndyCare may charge service fees on bookings, which will be clearly disclosed before payment.
  • Caregivers are responsible for reporting and paying any applicable taxes on their earnings.

7. Messaging

IndyCare provides in-app messaging. You agree not to use messaging for harassment, solicitation, or any illegal purpose. IndyCare may monitor messages for safety and compliance purposes.

8. Prohibited Conduct

You agree not to:

  • Use the App for any illegal or unauthorized purpose.
  • Misrepresent your identity, qualifications, or affiliations.
  • Harass, abuse, or harm other users.
  • Interfere with the operation or security of the App.
  • Circumvent payment processing through the platform.

9. Limitation of Liability

IndyCare is a matching platform and does not employ, supervise, or control Caregivers. IndyCare is not liable for:

  • The quality, safety, or legality of care provided by Caregivers.
  • Disputes between Clients and Caregivers.
  • Any injury, loss, or damage arising from use of the platform or services arranged through it.

To the fullest extent permitted by law, IndyCare’s total liability for any claim arising out of or related to these Terms or the App shall not exceed the amount paid by you (if any) to IndyCare in the 12 months preceding the claim.

10. Dispute Resolution

These Terms are governed by the laws of the State of Indiana, without regard to its conflict of laws principles. Any disputes shall be resolved through binding arbitration in Indianapolis, Indiana, unless otherwise required by applicable law.

11. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. You may delete your account at any time through the App settings or by contacting us.

12. Caregiver Background Check Authorization & FCRA Disclosure

This section applies to all users who register as Caregivers on IndyCare.

a. Disclosure

IndyCare317 Technologies LLC (“IndyCare”) may obtain a consumer report and/or investigative consumer report about you from Checkr, Inc., a consumer reporting agency, for the purpose of evaluating your eligibility to be listed as a Caregiver on the IndyCare platform.

A consumer report may include information about your character, general reputation, personal characteristics, criminal history, and other background data obtained from public records, court records, or other sources.

b. Authorization

By registering as a Caregiver and proceeding with the background check process, you:

  • Acknowledge receipt of this disclosure.
  • Authorize IndyCare and Checkr, Inc. to obtain and use consumer reports and/or investigative consumer reports about you for the purposes described above.
  • Understand that your authorization remains valid for the duration of your participation on the IndyCare platform and may be used for future background screenings as needed.

c. Your Rights Under the FCRA

  • You have the right to request a copy of any background check report obtained about you.
  • You have the right to dispute inaccurate or incomplete information in the report.
  • Before any adverse action is taken based on the report, you will be provided with a copy of the report and a summary of your rights.

d. Electronic Consent

By tapping “Agree” or submitting the background check form within the App, you provide your electronic signature and consent, which carries the same legal force as a handwritten signature.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes are posted constitutes acceptance of the updated Terms.
